Gay activists in California continue to play out their fear of the Great Unwashed, filing a demand with the state Supreme Court on Friday to keep off the November ballot a measure that would overrule the recent judicial legalization of same sex marriage. According to the AP story that appeared in the Minneapolis Star-Tribune:

Lawyers for Equality California filed a petition arguing that the proposed amendment to the California Constitution should be invalidated because its impact was not made clear to the millions of voters who signed petitions to qualify the measure before the state Supreme Court legalized same-sex unions.

“This court has recognized that gay and lesbian couples have a fundamental right to marry and, as of June 16, such couples have been getting married across the state,” the petition states.

“Rather than effecting ‘no change’ in existing California law, the proposed initiative would dramatically change existing law by taking that fundamental right away and inscribing discrimination based on a suspect classification into our state Constitution.”

This may be the most extreme form of the Brezhnev Doctrine that I’ve ever seen. The Doctrine, you may recall from your Cold War history, declared that no nation, having once been conquered for Communism, could ever be given back into the ravenous hand of capitalism or democracy. It embodied the justification for the invasion of Czechoslovakia in 1968.

What Equality California is saying here is this: despite the fact that same sex marriage was illegal in the state until June 16, 2008, now that the state Supremes have overturned the will of the people there is no possibility of ever changing this–they have conquered, and nothing, especially a vote of the Great Unwashed, may be permitted to challenge our victory. Despite the fact that a “dramatic change” in state law occurred less than six weeks ago, there may be no more changes in what has now been enshrined as an eternal, unalterable principle that will brook no opposition. And of course, to put the cherry on top of the sundae, EC is directing this demand at the very body whose ruling the referendum would overturn, thus giving them the opportunity to institute an iron-clad judicial totalitarianism on the citizens of California.
